It is your responsibility to review these Terms periodically for changes.

You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use of this Website by others. You may not use this Website to transmit any harmful, illegal, or offensive material, or for any unauthorized or illegal purposes.

In order to access certain features or services on this Website, you may be required to register an account. You agree to provide accurate, current, and complete information during the registration process, and to update this information as necessary. These Terms will be governed by and construed in accordance with the laws of The Netherlands Any dispute or claim related to these Terms will be subject to the exclusive jurisdiction of the courts in The Netherlands.

11. Termination
We reserve the right to suspend or terminate your access to the Website at any time, without notice, for any reason, including if we believe you have violated these Terms.

12. Modifications to the Website
We reserve the right to modify or discontinue the Website or any of its features at any time, without notice. We are not liable for any interruption, suspension, or discontinuation of the Website.

13. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published on the Website, constitute the entire agreement between you and Sculpt with Iris regarding your use of the Website.

14. Your responsibility
You are solely responsible for determining whether you are physically and mentally fit and/or adequately skilled to participate in Sculpt with Iris activities and/or classes. Risks from participating in Sculpt with Iris activities and/or classes may be aggravated if you are pregnant, suffer from an underlying medical condition, take medication, smoke cigarettes, have a family history of coronary disease, or have recently suffered an illness, injury or impairment. Accordingly, it is your responsibility to consult a physician before undertaking any fitness activity. It is also your responsibility to determine, during your participation in Sculpt with Iris activities and/or classes, whether you should discontinue your participation in such activities or take any other actions to protect your health or safety.

15. Warning of risk from fitness activities
Pilates, Aerobic, strength training and other fitness activities such as, floor and barre exercises, passive/resistive weight training, use of free weights, and other training devices are intended to challenge and engage the physical, mental and emotional resources of the participant.

Despite careful and proper preparation, instruction, medical advice, and conditioning, participation in fitness activities involves a risk of serious injury. All hazards and dangers cannot be foreseen. Depending on the particular activity, certain risks, dangers and injuries due to overexertion, lack of hydration, improper technique, ignoring safety precautions, failing to properly follow instructions, slips and falls, unfamiliarity with the equipment and/or exercise, equipment failure, failure in supervision/instruction, premises defects and other risks inherent to the particular activity exist. Nonetheless, you hereby agree to assume all risks of your participation in Sculpt with Iris activities and/or classes, whether known or unknown to you.

Depending upon a person’s physical condition, age and/or skill level, fitness activities can involve a substantial risk of the following types of injuries, among others: (i) heart attack, stroke and circulatory problems, (ii) bone and joint injuries, (iii) back and neck injuries, (iv) shin splints, (v) muscle strain and other muscle injuries, (vi) foot problems, (vii) psychological injury, pain or suffering, (viii) disfigurement, (ix) temporary or permanent disability (including paralysis), (x) death or (xi) economic loss.

In addition, a very small percentage of people may experience a seizure when exposed to certain visual images, including flashing lights or patterns that may appear on Sculpt with Iris. Seizures may have a variety of symptoms, including lightheadedness, altered vision, eye or face twitching, jerking or shaking of arms or legs, disorientation, confusion, or momentary loss of awareness. Seizures may also cause loss of consciousness or convulsions that can lead to injury from falling down or striking nearby objects. If you experience any of these symptoms, you should immediately stop exercising and consult a doctor.  It is the responsibility of all participants to have a complete physical examination by a medical doctor prior to beginning any activity.

Moral Injury
We recognize the potential psychological impact of fitness and wellness practices. While our programs are designed to promote physical and mental well-being, participants acknowledge that personal experiences and ethical beliefs may affect their emotional responses. By engaging with Sculpt with Iris, you agree to take responsibility for your well-being and seek appropriate support if experiencing distress related to moral or ethical concerns. We encourage open communication and self-care practices to ensure a positive and supportive experience for all members.

16. Waiver and general release of all claims and assumption of risk.
You recognize and acknowledge that there are inherent risks of physical injury to participants in any fitness activities, including when participating in Sculpt with Iris classes and activities, and you voluntarily agree to assume the full risk of any and all injuries, damages or loss, regardless of severity, that you may sustain as a result of said participation.  As a material inducement for Sculpt with Iris to permit you to participate in Sculpt with Iris activities and/or classes, to use the Sculpt with Iris app and facilities, you hereby, on behalf of yourself, your heirs, executors and assigns, fully, forever and irrevocably waive, release and hold Sculpt with Iris, its shareholders, directors, agents, representatives, employees, consultants, affiliated companies, partners, and successors (collectively “Sculpt with Iris Parties”) harmless from any and all claims (including, to the extent permitted by applicable law, claims alleging negligence on behalf of any Sculpt with Iris Party), injuries, damages or loss (including legal fees), present or future, foreseen or unforeseen, anticipated or unanticipated (collectively “Claims”), that you may have (or that accrue to you) against any Sculpt with Iris Party, and generally release and discharge the Sculpt with Iris Parties from any and all Claims, including but not limited to those involving: (i) participating in any supervised or unsupervised fitness activities, and (ii) use of any fitness equipment, including those provided or recommended by Sculpt with Iris, and you hereby promise never to assert or assist any other party in asserting, any claims or causes of action against any Sculpt with Iris Party in any matter that in any way relates to any Claims.

By participating in any fitness activities and/or visiting the Sculpt with Iris app or website you agree and acknowledge that you have read and fully understand the above important information, warning of risk, authorization, assumption of risk, and waiver and general release of all claims.

You represent that: you are at least 18 years old, and you have no health-related conditions that could affect my participation in Sculpt with Iris activities and/or classes. You have read and fully understand the above important information, warning of risk, authorization, assumption of risk, and waiver and general release and discharge of all claims.

17. Private Classes
At-home, Studio, and Online bookings. All new clients must fill in a waiver form before the first session Private lessons (at home, studio, and online) have a strict 24-hour cancellation policy. Late cancellations and no-shows will be charged the full price of the session. Sessions can be booked as a single, 5-pack, or 10-pack. All sessions must be prepaid before your session. Packs expire after 3 months from purchase date. If the client cancels outside the cancellation window, they’ll receive the class credit back, won't be charged for the session. If the instructor has to cancel the class, you will be notified as soon as possible, and the session will be rescheduled.

18. Business classes
Sculpt with Iris offers customized corporate group sessions (Business Classes) for companies and teams. By booking a business class, the client agrees to the following terms:

  • Booking & Payment:
    - All Business Classes must be booked and paid for in advance.
    - Invoices must be paid within 14 days of the invoice date unless otherwise agreed.
    - Prices are exclusive of VAT unless explicitly stated otherwise.
  • Cancellation Policy:
    - Cancellations or changes must be submitted in writing at least 48 hours before the scheduled session. Cancellations within 48 hours of the session will be fully charged. No-shows will be charged the full amount with no right to a refund.
  • Location & Materials:
    - Classes can take place on-site, on online (as per request).
    - Any additional costs for venue rental or specific materials are at the client’s expense.
  • Liability:
    - Participation in the sessions is at the participant’s own risk. It is the participant’s responsibility to assess their physical and mental suitability. Sculpt with Iris is not liable for injuries, damages, or losses resulting from participation in the sessions.

21. Online Zoom Group Classes
All classes must be booked in the name of the purchaser only. Payments for classes and packages are non-refundable or transferable. All Zoom group classes have a no cancellation policy. No-shows will be charged as if attended.

  • Free Trials and Discounts:
    Sculpt with Iris may offer free-trial or discounted subscriptions. When a free-trial period ends, your paid subscription begins (unless you have canceled) and you must pay the full monthly. If Sculpt with Iris provides a discount for the first subscription period, you must pay the discounted fee; in any renewal, you must pay the full fee.
  • Automatic Renewal:
    To the extent permitted by applicable law, subscriptions automatically renew for the subscription period until you cancel. Your payment method will be charged at the beginning of each subscription period. If a Purchaser offers a free-trial period, your payment method will be charged at the end of the free-trial period unless you cancel before the end of that period.
  • How to Decline Renewal:
    To pause or cancel a subscription, visit your account settings. Your changes will be applied to your next subscription period. 

22. On-Demand Library Access & Usage
Sculpt with Iris provides access to an on-demand video library for subscribers and select users (“On-Demand Library”). By accessing this library, you agree to the following additional terms:

  • Personal Use Only: Access to the On-Demand Library is granted solely for your personal, non-commercial use. You may not share your login credentials, screen recordings, or downloaded content with others.

  • Subscription Required: Some or all of the On-Demand Library may be restricted to paying members. Access will be revoked if payment fails, a subscription is canceled, or usage is found to be in breach of these Terms.

  • Content Availability: While we aim to provide consistent and high-quality content, we reserve the right to add, remove, or modify videos in the On-Demand Library at our discretion and without prior notice.

  • Intellectual Property: All videos remain the property of Sculpt with Iris and are protected by intellectual property laws. Reproduction, distribution, or re-uploading of videos is strictly prohibited.

  • Disclaimer: Use of the On-Demand Library is at your own risk. Always listen to your body, pause when necessary, and seek professional advice if you are unsure whether a specific class or movement is suitable for you.
